By accessing and using SkillUp, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Platform Description

SkillUp is a person-to-person services marketplace that connects independent sports coaches with students seeking real-time, one-to-one training sessions. Our platform facilitates:

Real-time, 1:1 coaching sessions between individual coaches and students
Scheduling and booking of personalized training sessions
Direct communication between coaches and students
Multiplatform access via iOS, Android, and web applications

SkillUp operates as an intermediary platform connecting service providers (coaches) with service seekers (students) and does not itself provide coaching services.

3. User Accounts

To use certain features, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your password
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

4. Content Ownership

Your Content: You retain ownership of content you upload. By uploading content, you grant SkillUp a license to use, display, and distribute your content on our platform.

Platform Content: All other content on SkillUp, including design, text, graphics, and software, is owned by SkillUp and protected by copyright laws.

5. Prohibited Activities

You may not:

Violate any laws or regulations
Infringe on intellectual property rights
Upload harmful, offensive, or inappropriate content
Harass, abuse, or harm other users
Attempt to gain unauthorized access to our systems
Use automated systems to access the platform

6. Coach/Creator Terms

Coaches on SkillUp are independent service providers, not employees of SkillUp. If you register as a coach:

You are an independent contractor providing person-to-person services directly to students
You must provide accurate credentials and qualifications
You are responsible for the accuracy of your training content and services
You set your own prices for lessons and services
You agree to Stripe Connect terms for payment processing
SkillUp takes a platform service fee on transactions (see pricing page)
You are responsible for your own tax obligations and reporting

7. Payments for Person-to-Person Services

Service Classification: Lesson bookings on SkillUp constitute payments for real-time, person-to-person services between individual coaches and students. These are not digital content purchases but rather payments for scheduled, real-time services similar to tutoring, fitness training, or consulting.

Payment Processing: All payments are processed securely through Stripe, our third-party payment processor. By making a purchase:

You authorize Stripe to charge your payment method
Payments are made directly to the coach via Stripe Connect
SkillUp retains a platform service fee
Refunds are subject to our refund policy and coach cancellation policies

Multiplatform Access: Content and services purchased on any platform (iOS, Android, or web) are accessible across all platforms where you are logged in with the same account.

7.1 Promotional Codes and Marketing Offers

SkillUp offers promotional codes and marketing offers through various channels including partner organizations, influencer campaigns, and special marketing initiatives. These promotional codes may be redeemed on any of our platforms (web, Android, or iOS).

Platform-Wide Access: Promotional codes and marketing offers created on our website or other platforms are accessible and redeemable across all platforms where you maintain an active account
Partner Codes: We partner with sports organizations, coaches, and influencers to offer custom promotional codes. These codes are managed through our web platform and may provide various discount levels or trial access
Multiplatform Redemption: Once you redeem a promotional code on any platform (web, Android, or iOS), your subscription or discount is accessible across all platforms
iOS In-App Purchase Limitation: Due to technical limitations of Apple's in-app purchase system, custom promotional codes created by our partners cannot be redeemed directly within the iOS app. iOS users may redeem promotional codes on our website (skillup-football.com/subscribe) and then access their subscription by signing into the iOS app
Account-Based Access: All subscriptions, whether obtained through in-app purchase, web checkout, or promotional codes, are tied to your account and accessible wherever you sign in

This multiplatform promotional code system ensures that marketing campaigns and partner offers reach users across all platforms while respecting platform-specific technical limitations.

7.2 iOS In-App Purchases and Subscriptions

Creator subscription plans (Creator Pro and Creator Business) purchased within the iOS app are processed through Apple In-App Purchase and are subject to Apple's terms and conditions. By subscribing through the iOS app:

Payment: Payment will be charged to your Apple ID account at confirmation of purchase
Subscription Plans:
- Creator Pro: $29.99/month or $287.88/year ($23.99/month billed annually)
- Creator Business: $79.99/month or $767.88/year ($63.99/month billed annually)
Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
Manage Subscriptions: You can manage and cancel your subscription by going to your Account Settings in the App Store after purchase
No Cancellation: You cannot cancel a subscription during the active subscription period
Free Trial: Any unused portion of a free trial period will be forfeited when you purchase a subscription

7.3 Refund Policy

Refund policies vary depending on how your purchase was made:

Apple In-App Purchases (iOS): For subscriptions purchased through Apple In-App Purchase, refunds are handled exclusively by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support. SkillUp cannot process refunds for Apple purchases.
Web and Android Purchases (Stripe): For purchases made through our website or Android app via Stripe, please contact us at support@skillup-football.com within 30 days of purchase. Refunds are subject to our 30-day money-back guarantee policy.
Lesson Bookings: Refunds for individual lesson bookings are subject to the coach's cancellation policy and must be requested through the platform.

8. Disclaimers

SkillUp is provided "as is" without warranties of any kind. We do not guarantee:

Uninterrupted or error-free service
Accuracy of content or training results
Quality of services provided by independent coaches
Security of data transmission

SkillUp is a marketplace platform and is not responsible for the actions, services, or content provided by independent coaches.

9. Limitation of Liability

SkillUp shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including any injuries sustained during training sessions with coaches. Coaches are independent service providers and SkillUp does not supervise or control their services.

10. Termination

We may terminate or suspend your account at any time for violations of these terms. You may delete your account at any time from your profile settings.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes via email or platform notification.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.
